Filing a DMCA Takedown Request

Required Information

To file a DMCA takedown request, you must provide the following information:

  • Your full name and contact information
  • Description of the copyrighted work being infringed
  • URL or location of the infringing content on our platform
  • Statement that you have a good faith belief the use is not authorized
  • Statement that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

Our Response

Upon receiving a valid DMCA takedown request, we will:

  • Review the request for completeness and validity
  • Remove or disable access to the allegedly infringing content
  • Notify the content creator of the takedown
  • Provide the creator with information about filing a counter-notification

Filing a Counter-Notification

When to File

If you believe your content was removed in error, you may file a counter-notification. This should only be done if you have a good faith belief that the content was removed by mistake or misidentification.

Required Information

Your counter-notification must include:

  • Your full name and contact information
  • Identification of the removed content and its location
  • Statement under penalty of perjury that you have a good faith belief the content was removed by mistake
  • Consent to local federal court jurisdiction
  • Your physical or electronic signature

Counter-Notification Process

Upon receiving a valid counter-notification:

  • We will forward it to the original complainant
  • The complainant has 10-14 business days to file a lawsuit
  • If no lawsuit is filed, we may restore the content
  • If a lawsuit is filed, the content remains removed pending court resolution

Repeat Infringers

BareVault maintains a policy of terminating accounts of users who are repeat infringers. We consider various factors when determining repeat infringement, including:

  • Number of valid DMCA takedown requests
  • Nature and severity of the infringements
  • User's response to takedown notices
  • Whether the user has filed valid counter-notifications
